What to Do After a Car Accident in New York

A car accident can completely alter a person’s life, especially if it causes serious injuries. After a New York car accident, the most important things to do are to seek medical attention, ensure everyone involved is safe, and contact the police. If you or a loved one were seriously injured in a New York car accident, Lever & Ecker’s personal injury attorneys can help you decide your next move and how to pursue compensation for your damages.

Were you injured in a car accident?

You may be entitled to compensation.

Ensure the Safety of Yourself and Others

After a car accident, the first step is to ensure the driver and any vehicle passengers are safe—if you are physically able to do so. If you are driving, pull the car over to a safe location, assess yourself and others for injuries, and use your hazard lights to warn oncoming traffic. If anyone involved in the accident exhibits significant pain, bleeding, or loss of consciousness, contact emergency services (911) immediately.

Call the New York Police Department to the Scene

Under New York law, you must report a motor vehicle accident to law enforcement if anyone is injured or if there is damage to property owned by someone not present at the time of the accident. Generally, however, it’s beneficial to call the police after a car accident, regardless of how severe it appears.

Gather Evidence at the Scene

If possible, try gathering as much evidence as possible at the crash scene. Exchange your insurance information with any other drivers involved and take photos and videos of property damage, the accident scene, and the general surroundings, all from multiple perspectives.

In addition, record details about the other vehicles involved and the time, date, location, weather, and road conditions at the time of the accident. If there are any accident witnesses, collect their names and contact information as well. Witness testimony can significantly support an insurance claim or car accident lawsuit.

Seek Medical Attention

Even if you believe you have not suffered any major injuries after a New York car accident, you should seek medical attention within 24 hours. Symptoms of some serious conditions, such as concussions and whiplash, are not always immediately apparent, and prompt medical attention will greatly increase the chance of timely diagnosis and treatment of any sustained injuries. Additionally, seeking immediate medical attention establishes a clear connection between the accident and your injuries, which is crucial for a successful car accident claim.

Notify Your Insurance Company of the Accident

In New York, drivers are legally obligated to report car accidents promptly to their insurance providers, even if they weren’t at fault. Most insurance policies mandate prompt notification, and delaying could jeopardize your coverage.

Because New York is a no-fault state, drivers must first go through their own auto insurance for medical coverage (and certain limited lost wages). However, in addition to the no-fault claim, people who have been seriously injured (as defined under New York law) can also pursue a car accident personal injury claim against the at-fault party or parties.

Report the Accident to the DMV

If your car accident has caused bodily injuries or property damage exceeding $1,000, you must report the accident to the New York Department of Motor Vehicles within 10 days of the crash. You must file a Report of Motor Vehicle Accident, form MV-104.

Do Not Admit Fault

When speaking to police officers at the scene, or insurance company representatives thereafter, do not allow them to get you to improperly admit that you caused or contributed to the accident.

Keep Detailed Records

It’s critical to collect and track all accident-related documentation after a crash. The documents might serve as vital evidence to support your claim and demonstrate the extent of the injuries and other losses you incurred. Important documents to keep for your claim include the following:

  • Police reports and citations
  • Evidence from the scene
  • Medical bills
  • Vehicle repair bills
  • Correspondence with insurance companies
  • Rental car receipts
  • Proof of lost wages due to injury-related absence from work
