Why We Take Fewer Cases by Design
At Lever & Ecker, we accept fewer cases so our attorneys have time to know each client and the details of each matter. We review the evidence, discuss decisions with you, and keep you informed as your case progresses.
Before accepting a case, we examine what happened and whether we can pursue compensation for your injuries and other losses. We also consider whether the matter fits our practice.
What Being Selective Means for Our Clients
You should be able to ask your lawyer a question and get an answer from someone familiar with your case. A limited caseload gives us time for those conversations and for the investigation your case requires.
We keep you informed without waiting for you to ask for an update. We also prepare your case for trial, should trial become necessary, while considering opportunities to resolve it through negotiation.
How We Decide Which Cases to Accept
We ask about the accident and review the information available. That review includes responsibility for the incident, the harm you suffered, and potential sources of recovery.
Liability
Liability means legal responsibility. We examine who may be responsible for the accident and what evidence supports a case against that person or entity.
Photographs, witness accounts, and accident reports may clarify what happened. If responsibility is disputed, further investigation may be needed before we can decide whether to accept the case.
Injuries and Damages
We ask how your injuries affect your daily life and what treatment you have needed. We consider past and future pain and suffering, including the effects of surgeries, as well as medical expenses and past and future lost income.
Your medical history may show how the accident caused a new injury or aggravated an earlier one. Tell us about prior injuries and any changes in your symptoms. You can contact us before you have gathered all your records.
Insurance Coverage
We review the insurance coverage that may apply and consider whether other sources of recovery need to be investigated.
Policy limits affect how much may be recovered through a particular policy. They do not determine the extent of your injuries and other losses. If you do not know what coverage exists, tell us what information you have.
Direct Access to Your Attorney
If we represent you, you will have direct access to your attorney to discuss the evidence, an offer, or a concern about your case.
Our staff handles records and scheduling as well. When you need legal advice, ask to speak with your attorney. Scheduling a call gives you time to discuss your questions.
What Happens If We Decline Your Case
If we do not accept your case, another attorney may still be able to represent you. That attorney may handle a different type of matter or reach a different assessment after reviewing the facts.
Referrals
Ask whether a referral is available if we cannot represent you. For example, we refer workers’ compensation proceedings to other counsel. We handle appropriate third-party personal injury lawsuits for injured workers.
Contact the referred attorney to find out whether the attorney will accept your case. A referral alone does not begin representation.
Statute of Limitations Reminder
If we decline your case, contact another attorney promptly. An inquiry or referral does not, by itself, pause a filing deadline.
Many New York personal injury lawsuits have a three-year filing period under CPLR 214, but exceptions apply. Cases involving public entities may require a notice of claim within 90 days under General Municipal Law 50-e. Ask an attorney to assess the deadlines for your circumstances rather than assuming you have three years.

Frequently Asked Questions
Why would you turn a case down?
A case may fall outside our practice, or the available information may not support pursuing it. We consider responsibility for the accident, the injuries and other losses, and potential sources of recovery. Another attorney may assess the case differently.
Who will I talk to?
You may first speak with intake staff about the accident before an attorney reviews the matter. If we accept your case, you will have direct access to your attorney. Our staff also handles records and scheduling.
