What Qualifies as a Catastrophic Injury?

A catastrophic injury is one resulting in long-term or permanent pain, disability, scarring, or disfigurement. Such an injury can profoundly affect your physical, mental, social, and financial well-being.

Below are examples of injuries typically considered catastrophic:

  • Dismemberment
  • Traumatic brain injury
  • Spinal cord injuries
  • Organ failure
  • Severe burn injuries
  • Loss of vision or hearing
  • Permanent and severe facial scarring
  • Permanent nerve damage
  • Death

This is not an exhaustive list. If you have suffered any injury with severe negative effects on your quality of life because of someone else’s negligence, call our knowledgeable catastrophic injury attorneys in the Bronx today at (718) 933-3632.

Catastrophic Injuries Can Affect You for Life

One of our past clients is living with permanent paralysis in one of her arms as a result of slipping and falling. Another client needed multiple surgeries to reconstruct her leg after a car struck her. Their lives will never be the same, and this is true for countless catastrophic injury victims.

When you sustain a catastrophic injury, your life is instantaneously transformed into a series of surgeries and medical treatments as you cope with chronic pain and disability. You may be unable to perform the type of work you did before or activities you previously enjoyed. Your financial status may suffer dramatic setbacks that even threaten your ability to keep a roof over your head.

You May Be Eligible for Substantial Compensation

Compensation for an accident resulting in catastrophic injuries may include the following:

  • Economic damages – compensation for your monetary losses, such as property damage, past and future medical expenses, incidental expenses, and past and future lost wages
  • Non-economic damages – compensation for losses to your quality of life, such as pain and suffering, emotional distress, and loss of enjoyment of life
  • Punitive damages – damages awarded in limited cases when there is clear and convincing evidence that the defendant’s conduct was deliberate or grossly negligent
  • Wrongful death damages – damages awarded to surviving family members for monetary losses related to the death, such as funeral expenses and loss of financial support

Who Is Responsible for Your Catastrophic Injuries?

Anyone who caused or contributed to your injuries by failing to exercise reasonable care may be held liable.

If you were injured in an automobile accident, your first compensation must come from your own no-fault insurance coverage. You can file a claim against the other driver if your injuries meet the threshold for serious as defined by the state. This Motorcycle riders are not entitled to no-fault coverage. Bicyclists and pedestrians are covered under no-fault insurance policies if they own a vehicle and have such a policy.

If you are a construction worker injured on the job, you are most likely eligible for workers’ compensation through your employer. You generally cannot sue an employer covered by workers’ compensation. However, you may be entitled to sue any third parties that contributed to your accident.

When we take on your catastrophic injury claim, we will thoroughly investigate and identify all the parties liable for your injuries. The table below lists who may be liable for different types of accidents.

Time Is Running Out to File Your Catastrophic Injury Claim

New York’s statute of limitations requires most catastrophic injury victims to file their claims within three years of the accident. If a New York City agency or other municipal entity is liable for your injuries, you must file a Notice of Claim within 90 days after your accident, and you have just one year and three months to file your injury lawsuit.

Before you file your case, it must be determined who is liable for your accident and how much your claim is worth. An experienced Bronx catastrophic accident lawyer will need time to investigate and prepare your claim before filing. Reach out to one of our accomplished catastrophic injury lawyers as soon as possible after your accident. If you miss the filing deadline, you will lose your opportunity to pursue compensation.

Types of Bronx Catastrophic Injury Cases We Handle

Bronx residents face a high accident risk in apartment buildings, congested roads, and dangerous job sites. We handle catastrophic injury cases originating from a variety of causes. By way of example:

Motor Vehicle Accidents

Accidents involving motor vehicles in the Bronx often affect vulnerable roadway users, including pedestrians, motorcycle riders, and bicyclists. The Bronx is home to the most dangerous stretch of road in the Big Apple. According to the Bronx Times, 12 people have died on a short 1.5-mile stretch of East 138th Street between 2014 and 2023.

New York City was the first municipality in the country to implement Vision Zero, a program designed to increase the safety of all roadway users until the number of fatalities reaches zero. Since it started in 2014, traffic fatalities have decreased overall by 16 percent. However, a study by Transportation Alternatives found that the number of deaths on New York City roadways in 2023 was the same as in 2014.

Pedestrian Accidents

In 2023, 12 pedestrians died, and 1,375 were injured in traffic accidents in the Bronx. Pedestrians are among the most vulnerable roadway users in the Bronx because they have no protective gear and no enclosed vehicle to absorb the impact of a collision. Most fatal pedestrian accidents involve large vehicles, such as trucks and SUVs.

We have won numerous verdicts and settlements in the millions for catastrophically injured pedestrians, such as the $1.9 million we recovered for a pedestrian who suffered significant foot injuries from being hit by a car.

Bicycle and E-Bike Accidents

Citywide, 2023 was the deadliest year for bicyclists since 1999, according to Transportation Alternatives. In the Bronx alone, three bicyclists were killed, and 475 were injured by accidents that year. Two of the three bicyclists killed and 168 of the injured bicyclists were riding e-bikes, according to the New York City Crash Mapper. Most bicycle accidents happen in areas that lack bicycle lanes.

The Bronx has some of the most deficient bicycle infrastructure of all the five boroughs. In the areas with bicycle lanes, cars and large trucks often illegally park in them, forcing bicyclists to share lanes with impatient and reckless drivers.

Motorcycle Accidents

Motorcycle riders are also vulnerable on Bronx streets because they lack the protection of an enclosed vehicle. The most common catastrophic injuries in motorcycle accidents include leg injuries, head injuries, burns, and road rash. Our firm recently recovered $1.25 million for a motorcycle accident victim who suffered severe leg injuries requiring surgery.

Apartment Complex Injuries

In December 2023, a 96-year-old apartment building collapsed. Luckily, no one was hurt, but as partner David Lever wrote in an Op-Ed in CityLimits, it is only a matter of time before it happens again. The average building age in the city is around 90 years old, and the potential for catastrophic injury and death in such a collapse is high.

Bronx apartment dwellers often live with numerous code violations that threaten their safety. Our attorneys recently obtained an $850,000 settlement for the family of an infant who suffered second-degree burns from scalding water in a Bronx apartment.

Construction Accidents

According to the Bureau of Labor Statistics, the private construction industry had the highest number of fatalities of all industries in New York City. The most common causes of construction accidents include:

  • Falls from scaffolds and ladders
  • Falling objects and construction equipment
  • Slips and trips causing falls
  • Exposure to harmful substances
  • Transportation incidents
  • Violence

In 2022, 72 Bronx construction workers were injured, and one was killed. The same year, the NYC Department of Buildings found 8,562 code violations and issued 1,130 stop work orders in the Bronx—the second highest of all the boroughs.

We recently obtained a $1.5 million settlement for a construction worker who fell from an elevated platform and suffered hip and wrist fractures that required surgery. To recover this settlement, we had to defeat the defense arguments that the fall was the worker’s fault.

Large Commercial Truck Accidents

The Cross Bronx Expressway is one of the most congested highways in the nation, with approximately 300 diesel trucks traversing it every hour. In February 2024, large commercial trucks were involved in 70 accidents in the Bronx. Due to their size and weight, large trucks increase the risk of catastrophic injuries in motor vehicle accidents compared to passenger vehicles.
